Refund Policy

This Refund Policy explains how refunds work for the ProofProtect platform, operated by GuardedContent Pty Ltd trading as ProofProtect. It covers two different kinds of payment: subscription fees you pay to us for a ProofProtect plan, and purchases made by End Users through a photographer’s gallery or store. It forms part of, and should be read together with, our Terms of Service.

1. Subscription fees

Paid ProofProtect plans are billed in advance for each billing period. As set out in our Terms of Service:

  • You may cancel at any time. Cancellation takes effect at the end of the current billing period, and you retain access to paid features until then.
  • Except where required by law, we do not provide pro-rata refunds for partial billing periods, and cancelling part-way through a period does not entitle you to a refund of that period’s fees.
  • Fees are shown in Australian dollars (AUD) and are inclusive of GST where GST applies. Because the price you pay already includes GST, any refund we give also includes the GST component of the amount refunded.

If you believe you were charged in error (for example, a duplicate charge), contact us at support@guardedcontent.com and we will investigate.

2. Gallery and store purchases

The Services let photographers (“Customers”) sell galleries, prints, products, and digital downloads to their clients and other End Users. For those purchases, as set out in our Terms of Service:

  • The photographer is the seller of record. ProofProtect acts only as a technology and payment-facilitation provider and is not a party to the sale.
  • The photographer is responsible for setting prices, describing products accurately, fulfilling orders, and managing refunds, returns, and chargebacks in accordance with applicable law and their own stated policy.
  • If you bought something through a gallery or store and want a refund, please contact the photographer or studio you purchased from. Their refund terms, not ours, govern that purchase.
  • Where tax was applied to a purchase, any refund includes the corresponding tax component of the amount refunded.

Because digital downloads are delivered immediately, a photographer may limit or decline refunds on digital goods once delivered, subject to your non-excludable consumer rights described below.

3. Your consumer rights

Australian Consumer Law. Nothing in this Refund Policy excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Competition and Consumer Act 2010 (Cth) (including the Australian Consumer Law) or any other law that cannot lawfully be excluded (including, if you are outside Australia, any consumer protection laws of your place of residence that cannot lawfully be excluded). Where goods or services come with guarantees that cannot be excluded, you may be entitled to a remedy regardless of anything stated above.

4. How to request a refund

  • Subscription fees: contact us at support@guardedcontent.com with your account details and the reason for your request.
  • Gallery or store purchases: contact the photographer or studio you bought from directly. If you cannot reach them, you may still contact us at support@guardedcontent.com and we will try to help put you in touch.

Approved refunds are returned to the original payment method. The time it takes to appear on your statement depends on your bank or card issuer.
